    In-House IVDs (Article 5(5))

    In one line
Devices manufactured and used within a single EU health institution under conditions in IVDR Article 5(5).
    Definition
Article 5(5) exempts devices manufactured and used exclusively within health institutions established in the Union from most IVDR requirements, provided conditions are met: an appropriate quality management system, justification that patient needs cannot be met by an equivalent CE-marked device, documentation on manufacturing and performance, and public declaration and reporting to the competent authority.
    Why it matters
In-house diagnostics (also known as laboratory-developed tests or LDTs in EU practice) are a major route for niche and rapidly evolving assays. Transition provisions extended key Article 5(5) documentation deadlines to 2028 and 2030 for high-risk classes, but the basic conditions apply now.
    Common pitfalls
    • •Assuming the exemption covers cross-institution networks. It applies to a single health institution.
    • •Overlooking the requirement to justify that no equivalent CE-marked device meets the need.

Why compare MedTech terms side by side?

MedTech terminology is full of pairs that look interchangeable but carry very different regulatory, clinical, and commercial consequences. Picking the wrong framework, pathway, or standard early in a project can add months to a submission, invalidate clinical evidence, or trigger an audit finding. Side-by-side comparison is the fastest way to surface those differences before they become costly mistakes.

Each comparison on this page pulls from the same vendor-neutral, sourced definitions used throughout the MedTech Terms glossary. You see the one-line summary, the formal definition, why it matters in practice, common pitfalls, and the primary sources (FDA guidance, EU MDR/IVDR articles, ISO/IEC standards, MDCG documents, IMDRF principles) that back each entry. That makes the comparison defensible in regulatory strategy memos, design reviews, and submission narratives.
