## Definition

Small Business Innovation Research (SBIR) and Small Business Technology Transfer (STTR) are U.S. federal grant programs that fund early-stage R&D at small businesses. NIH, NSF, DoD, and BARDA are the most relevant agencies for MedTech. Phase I (~$300K) funds feasibility; Phase II (~$2M) funds prototype and validation. 

What the regulation says

SBIR/STTR grants, while providing  [non-dilutive funding](/terms/non-dilutive-funding) for MedTech innovation, fall outside the direct purview of typical regulatory frameworks like 21 CFR Part 820 for  [Quality System Regulation](/terms/qsr) or  [ISO 13485](/terms/iso-13485) for Medical Devices, since they primarily concern funding mechanisms rather than product quality or safety. However, the R&D activities funded by these grants are still subject to relevant regulations and standards based on the nature of the medical device being developed, such as FDA design control requirements found in 21 CFR 820.30 during Phase II. Similarly, if clinical studies are involved, then  [Good Clinical Practice](/terms/gcp) (GCP) guidelines, like those outlined by the ICH E6(R2) guideline, must be followed.

-   • Assuming that the technical success criteria for a grant are the same as the regulatory requirements for market clearance or approval can lead to significant delays. 
-   • Mismanaging intellectual property generated during the grant project can create future regulatory and commercial challenges, despite the grants’ general policy of retaining IP with the small business.
