# Ministry of Food and Drug Safety (Korea)

South Korea's regulator for foods, drugs, cosmetics, and medical devices.

Reviewed by [Christian Espinosa, Founder, Blue Goat Cyber](/authors/christian-espinosa) Last reviewed May 5, 2026

## Definition

MFDS regulates medical devices under the Medical Devices Act, classifying products into four risk classes. Higher-risk devices typically require KGMP certification and in-country clinical data when applicable.

What the regulation says

The Ministry of Food and Drug Safety (MFDS) is the regulatory body in South Korea responsible for medical devices, operating under the Medical Devices Act. MFDS classifies medical devices into four risk classes, similar to international standards, with higher-risk devices necessitating more stringent conformity assessment pathways. Requirements for market authorization often include demonstrating compliance with KGMP (Korean Good Manufacturing Practices) and providing clinical data, especially for novel or high-risk devices.

## What this means in practice

MFDS participates in [MDSAP](/terms/mdsap) as an Affiliate Member and offers an innovative medical device fast-track designation for digital health and AI-based devices.

## Examples

- A U.S. manufacturer of a Class III AI-powered diagnostic device must secure KGMP certification and may need to conduct supplementary clinical trials in South Korea to satisfy MFDS requirements.
- A European company developing a Class II surgical instrument seeks market entry in South Korea and needs to ensure their quality management system aligns with KGMP and submit appropriate technical documentation to MFDS.
- A startup with an innovative digital health application for disease management applies for the MFDS fast-track designation for innovative medical devices, streamlining the review process due to its AI component.

Common pitfalls

- • A common pitfall is underestimating the specific requirements for in-country clinical data, which can differ significantly from those accepted by other regulatory bodies.
- • Manufacturers sometimes overlook the nuances of the KGMP certification process, which has unique interpretations compared to other GMP standards.
- • Assuming that participation in MDSAP as an affiliate member means full acceptance of MDSAP audit reports without additional MFDS-specific requirements can lead to delays.

## Frequently asked questions
